Your Firm For Experienced Premises Liability Cases

Premises liability means that the owner is responsible or "liable" for their "premises." A premise can be a home, hotel, supermarket, retail store, pool, apartment building or even a city sidewalk or road.

If you are hurt because a property owner failed to take care of a problem that was obvious then you may have a premises liability case. Premises liability can include:

  • Structural design flaws, including guardrails
  • A slippery crosswalk
  • Unsafe conditions or lack of security
  • Environmental hazards
  • Negligence that caused death
  • Hazardous traffic patterns
  • Poorly maintained floors, stairwells or ceilings
  • Faulty or malfunctioning equipment such as escalators or elevators

How Liability Is Determined

While liability laws vary from state to state a premises liability case is a personal injury case filed against the person who owns or controls the property where you were injured. A premises liability case is filed on the basis that you were hurt due to a hazard on the property. If that hazardous condition caused your injury, you can sue. In Texas law you have two years in which to file suit against a negligent property owner. This two year period is called a "statute of limitations."

A premises liability case is not filed just because you were injured on the property. The injury must be the cause of some form of negligence on the part of the property owner. Premises liability cases include:

  • Slip and fall and trip and fall
  • An injury caused by something falling on you
  • A dog bite or other pet animal attack
  • Construction defects or manufacturing defects
  • Dangerous property: unchecked criminal activity
  • A lack of lighting or security

Texas law allows you to file a claim for your medical bills. You are also allowed to sue for:

  • Lost wages
  • Medical bills
  • Pain and suffering
  • Rehabilitation and physical therapy services
  • Compensation for losing a loved one
  • Mental anguish
  • Funeral expenses
  • Loss of household income
